What is an affidavit or sworn statement? The same is done in writing made especially under oath or affirmation before a magistrate or authorized official. In Latin, the term "affidavit" means "he (she) has sworn an oath", and an affidavit is always a document written under oath. If it contains a lie, the person who made it can be prosecuted. Affidavits are often used in court when it is not possible for someone to appear in person. Police officers generally must file an affidavit with a judge to obtain a search warrant. Affidavits (as opposed to similar signed statements called depositions) are generally made without opposing counsel present and able to ask questions.
